2025 City of Sarnia Bluewater Trails Photo Contest – Official Rules

The City of Sarnia Bluewater Trails Photo Contest will be hereinafter referred to as The Contest.

      1. Eligibility – the City of Sarnia Bluewater Trails Photo Contest is open to all legal residents of Canada. All entrants must either be 18 years of age OR have entered with the consent of a parent or legal guardian (for entrants that are under the age of 18 at time of entry) in order to be eligible to enter The Contest. City of Sarnia employees, Bluewater Trail Committee members, The Contest volunteers, prize suppliers; and their immediate family members (spouse, parent, child, siblings) or persons living in the same household of said individuals are ineligible to win prizes from The Contest however are permitted to submit photos to The Contest for the purposes of displaying. Eligibility determinations are at the sole discretion of the BWTC. A parent or legal guardian must sign the liability release if a winner is under the age of 18 at time of entering The Contest. Photos must be taken within the City of Sarnia to be eligible.

      2. Submitting Entry – No purchase is necessary to submit photos into The Contest. Entries may be submitted within the Contest Period as displayed on the BlueWater Trails Committee (BWTC) and website and considered eligible as long as entered by 11:59PM EST on the date of The Contest period ends. Eligible entries must include photos in line with The Contest themes as posted on the BWTC website as ‘Categories to Enter’. Videos will not be accepted. Photos will be collected and displayed on the BWTC website; photos deemed not suitable or inappropriate by BWTC will not be displayed and the BWTC is not required to communicate with any entrant.

        There are no limits to the number of entries per person as long as the same photo is not submitted more than once. BWTC and the City of Sarnia assume no responsibility for lost, late, misdirected or corrupted entries regardless of cause.

         

      3. Claiming of Prizes – The winner(s) assume any and all liability for any injury or damage caused or claimed to be caused by entering The Contest or redemption of a prize. BWTC reserves the right to substitute a prize of equal or greater value if an intended prize is unavailable at the time of award. Prizes are awarded as is and without warranty and neither BWTC or the City of Sarnia shall be responsible for any costs associated with acceptance or use of a prize.

      4. Display of Entry Photos – by submitting an entry or accepting a prize, all entrants of all ages consent to the use of their photo, name and city of residence without further notice or compensation for the administration of The Contest and any and all publicity carried out by the BWTC and City of Sarnia related to The Contest including promotion by The Contest sponsors. The BWTC does not commit to display, publicize or credit any entrant, regardless of winning. Entrants represent and guarantee that their submitted photo is original, does not infringe the rights of any third party and that they have obtained all necessary permissions for persons depicted. An original photo means that the photo is not photo-shopped, enhanced and has not been altered or generated by artificial intelligence.

      5. Selection of Winners – winners will be selected by judges appointed to The Contest by the BWTC. The BWTC reserves the right to any time change the appointed judges. All selection of winners will be final and binding and not subject to appeal or audit. The winners will be chosen based on evaluation of the following criteria: Originality, Quality and Impact as it relates to The Contest themes posted on the BWTC website.

        If an entrant is selected as a winner and does not meet the eligibility criteria outlined in section 2 above, the entry will be disqualified without prize and the selection process will continue. Prior to receiving a prize all winners must sign and return a BWTC Confirmation of Eligibility and Liability Release form.

        The odds of winning will depend on the amount of eligible entries submitted to The Contest.

         

      6. Contacting Entrants – Selected winners will be notified by the BWTC within (3) weeks of contest closure. The BWTC will make up to 3 attempts to contact entrants. If an entrant cannot be contacted within (3) weeks of contest closure the BWTC reserves the right to disqualify the entrant without any liability or responsibility to the disqualified entrant.

      7. Personal Information – collected related to submission to The Contest will be used for the purposes of administering The Contest, including contacting potential winners and displaying entry photos as described in section 4 above, including for purposes of promoting The Contest through sponsors.

      8. Reservation of Rights – the City of Sarnia BWTC reserves the right to modify, cancel, suspend or terminate The Contest without prior notice. The City of Sarnia BWTC reserves the right to amend The Contest official rules for any reason. 

        9.  

      9. Grant of Rights – By entering The Contest each entrant grants the City of Sarnia BWTC a royalty-free, irrevocable transferable non-exclusive license to publish, modify, use, reproduce and display his/her submitted photo and to incorporate it into other media or technology including for promotional purposes in connection to The Contest.

        By entering the Contest each entrant agrees to release and hold harmless the parties defined in Section 10 below from any and all claims based on publicity rights, defamation, invasion of privacy, copyright or trademark infringement, intellectual property or liability related cause of action that relates in any way to an entrant’s submitted photo.

         

      10. Disclaimer and Release – Participation in The Contest constitutes an agreement by individual entrants to comply with all conditions of these Official Contest rules. The BWTC reserves the right to disqualify entrants found to be tampering with any aspect of The Contest as determined by the BWTC.

        By entering The Contest each entrant releases the City of Sarnia BWTC and sponsors of The Contest from any liability for any claims, costs, losses or damages arising in connection with The Contest or with the accepting and possession and use of any prize from The Contest. The BWTC disclaims any liability for:

        11. i) any errors or omissions or failure in transmission of entries or the operation of The Contest

        ii) security or privacy of information transmitted via computer networks or for breaches of privacy by third party computer hackers

        iii) problems or technical difficulty of any hardware, software, providers or servers

        iv) theft, destruction or unauthorized access to entries

        v) failure of receipt of entry by deadlines due to technical problems including internet and website traffic congestion

        vi) incomplete or misrouted entries

        vii) injury or damage to any computer from participating in or downloading materials from The Contest

        viii) damages or losses associated with the use of or participation in any prize from The Contest

        ix) any suspension or termination of The Contest

        1. Governing Laws – The Contest is subject to the laws of the Province of Ontario and the federal laws of Canada. Any disputes arising shall be resolved in the courts of Ontario sitting in Sarnia Ontario.

        2. Questions and Inquiries – any questions should be submitted to the City of Sarnia Bluewater Trails Committee via the BWTC website.
